1. Acceptance of Terms

By accessing and using the online platform mylensfolio.com, the user declares having read, understood, and fully accepted these Terms of Use. If you do not agree with any of the terms established here, you should not use our services.

2. Definitions

• Platform: Refers to the "myLensFolio" service and all its components
• User/Photographer: Person or entity creating an account on the platform to sell photos
• End Customer: Person purchasing photos through the platform
• Content: Photos, images, texts, and other materials uploaded to the platform
• Plan: Subscription modality chosen by the user

3. Registration and Account

3.1. To use the platform, the user must create an account providing true, complete, and updated information.

3.2. The user is responsible for the confidentiality of their password and for all activity that occurs in their account.

3.3. We reserve the right to refuse or cancel accounts that violate these terms or that are used for illegal activities.

4. Plans and Payments

4.1. The available plans and respective prices are defined on the platform and may be changed with 30 days prior notice.

4.2. Payments are processed through the methods available on the platform and are subject to the terms of the respective payment processors.

4.3. Paid plans can be renewed by the user in the "Account" section in the control panel. If the account is not renewed in time, the control panel becomes limited to that section so the user can take necessary precautions.

5. Copyright and Content

5.1. The user maintains all copyright over the photos they upload to the platform.

5.2. By uploading content, the user grants the platform a non-exclusive license to store and display the photos to end customers.

5.3. It is strictly prohibited to upload content that violates third-party copyright or that is illegal, offensive, or inappropriate.

5.4. Photos uploaded to the platform are automatically resized to small size. We are not responsible for file loss, nor is there an option to download files. We are not a storage service.

6. Commission Payment

6.1. The platform charges a commission on each sale made, according to the plan chosen by the user.

6.2. Commission payments are processed by the user in the "Account" section of the control panel, at any time from reaching a minimum of 20 Euros up to 75 Euros. Once reaching 75 Euros, the control panel becomes available only in the "Account" section until payment of the outstanding amount.

6.3. Upon successful payment, the respective invoice will be sent by email to the user.

7. Responsibilities

7.1. The user is exclusively responsible for the content they upload and for the sales made through the platform.

7.2. The platform is not responsible for disputes between photographers and end customers, acting only as a technical intermediary.

7.3. In case of violation of these terms, we reserve the right to suspend or terminate access to the platform.

8. Privacy and Data

The processing of personal data is carried out in accordance with our Privacy Policy and with the General Data Protection Regulation (GDPR). By using the platform, the user consents to the processing of their data for the purposes described therein.

9. Limitation of Liability

The platform is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted or error-free. In no case will we be responsible for any indirect, incidental, or consequential damages resulting from the use or inability to use the platform.

10. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be communicated to users with a minimum advance notice of 30 days and continued use of the platform after changes constitutes acceptance of the new terms.

11. Applicable Law

These Terms are governed by Portuguese law. Any dispute will be submitted to the jurisdiction of Viseu district, with express waiver of any other.
